Drinking game. Read this first.

NightDare is a party drinking game for adults of legal drinking age. By playing you accept the risks in Section 4, including that we are not responsible for harm from drinking or dares. Please read our responsible-play guidelines.

1. Acceptance of Terms

By accessing or using NightDare (the "Service") at nightdare.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. We may update these Terms at any time, and your continued use means you accept the changes.

2. What the Service Is

NightDare is a phone-first, multiplayer party drinking game. A host starts a room, friends join with a code on their own phones, and the Dare Master runs the rounds: dice races, dares, minigames, and prompts where losing or passing means taking a drink.

The Dare Master narrates scenes, plays the world and its characters, and responds to what players type. The story and prompts are improvised in real time and are meant for fun. The Service is entertainment. It is not medical, legal, safety, or professional advice of any kind.

3. Age Requirement and Eligibility

  • Legal drinking age. The Service is a drinking game intended for adults who have reached the legal drinking age where they live (21 years old in the United States). You must be of legal drinking age to use the Service with alcohol. Minors are not permitted to play with alcohol.
  • Minimum age to use the Service. You must be at least 18 years old to create an account or use the Service. If you are not yet of legal drinking age, you may only play with non-alcoholic drinks.
  • No age verification. We do not verify your age and we rely on your truthful representation. Do not use the Service if you do not meet these requirements.
  • Account security. You are responsible for activity that happens through your account and for keeping your sign-in details safe.
  • Accurate information. Provide a valid email address so we can sign you in and contact you about your account.

4. Drinking, Risk, and Your Safety (Important)

This Section explains the risks of a drinking game and your responsibility for them. Please also read our responsible-play guidelines, which are part of how you keep yourself and your friends safe.

  • You control your drinking. The Service suggests prompts; it does not force anyone to drink. You may drink less, swap in water or a non-alcoholic drink, skip a round, or stop at any time. No one owes anyone a drink.
  • Drink responsibly. Know your limits, pace yourself, eat, and stay hydrated. Never drink and drive, and never let a friend who has been drinking drive.
  • Health. Do not drink as part of this game if you are pregnant, take medication that interacts with alcohol, are in recovery, or a doctor has advised you not to drink.
  • Emergencies. If someone shows signs of alcohol poisoning, call 911 immediately. Do not wait.
  • We do not provide alcohol. We do not provide, serve, sell, deliver, or control any alcohol, and we are not present at your game.

ASSUMPTION OF RISK. By using the Service you acknowledge that drinking alcohol and party dares carry real risks, including intoxication, injury, illness, alcohol poisoning, accident, and death. You voluntarily and knowingly assume all of these risks for yourself and accept full responsibility for your own choices and conduct while playing.

NOT OUR RESPONSIBILITY. NightDare, its operators, owners, and affiliates are not responsible or liable for any injury, illness, accident, property damage, or death that results from playing the Service, including from alcohol use, dares, or the actions of other players. If you host or organize a game, you are responsible for the safety of everyone at your table.

5. Player Conduct

You are responsible for everything you type into the game, including character names, actions, and chat. You agree NOT to submit content that:

  • Is harassing, hateful, threatening, or abusive toward other players or any group
  • Is defamatory, obscene, or sexually explicit involving minors
  • Promotes illegal activity or violates any applicable law
  • Pressures or coerces anyone into drinking against their will or past their limits
  • Infringes anyone else's intellectual property or privacy
  • Attempts to manipulate the Dare Master into producing prohibited content

Play is collaborative. Be a good table-mate and respect every player's right to skip a round or decline a dare. We may remove content or suspend accounts that break these rules.

6. Your Content and Generated Stories

You keep ownership of the original text you submit. To run the game, you grant us a worldwide, non-exclusive, royalty-free license to store, process, transmit, and display your submissions to operate the Service and continue your adventures.

The Dare Master's narration is generated automatically and is fictional. Similar prompts may produce similar stories for different players, so generated narration is not guaranteed to be unique to you. Do not rely on generated content as factual, professional, legal, medical, or safety advice.

7. Payments and Subscriptions

  • Optional Support: The core game is free to play. Optional paid support (for example, the Supporter plan) helps keep the Dare Master running and funds the physical board game.
  • Billing: Paid plans are processed securely through Stripe. We do not store your full card details.
  • Auto-Renewal: Recurring plans renew automatically until you cancel.
  • Cancellation: You can cancel at any time from your account settings, and access continues through the end of the paid period.
  • Refunds: Refunds are at our sole discretion.

8. Alpha Status and Availability

  • Provided "As Is": The Service is offered without warranties of any kind.
  • Changes: We may add, change, or remove features at any time.
  • Game Data: During alpha, sessions, characters, and other game data may be reset or lost. Do not treat the Service as permanent storage.
  • Availability: We do not guarantee uninterrupted access.

9. Prohibited Uses

You agree not to:

  • Reverse engineer or attempt to extract source code or prompts
  • Use automated systems to abuse, scrape, or overload the Service
  • Resell, sublicense, or commercially exploit the Service without permission
  • Interfere with, disrupt, or attempt to bypass access controls

10. Termination

We may suspend or terminate your access at any time, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service ends immediately.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SAFE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS. THE SERVICE IS ENTERTAINMENT, NOT ADVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIGHTDARE, ITS OPERATORS, OWNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL. WE SHALL NOT BE LIABLE FOR ANY BODILY INJURY, ILLNESS, ACCIDENT, OR DEATH ARISING FROM YOUR USE OF THE SERVICE, INCLUDING FROM ALCOHOL CONSUMPTION, DARES, OR THE ACTIONS OF OTHER PLAYERS, WHICH YOU ASSUME UNDER SECTION 4. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS OR FIFTY US DOLLARS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify and hold harmless NightDare, its operators, owners, and affiliates from any claims, damages, losses, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service, including your own drinking and the dares you choose to do
  • Any game you host or organize, including the conduct and safety of your guests
  • Your violation of these Terms
  • Content you submit during play
  • Your violation of the rights of another party

14. Governing Law

These Terms are governed by the laws of the United States and the state in which the operator is organized, without regard to conflict-of-law rules. Any legal action arising from these Terms shall be filed in the courts located in the United States.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the "Last Updated" date above. Continued use after changes means you accept them.
